Governor Brown Seeks Fundamental Changes to Sentencing and Juvenile Direct Filing 

Governor Brown has announced his plan to seek fundamental change to California’s sentencing scheme by way of ballot initiative in 2016. Should this measure pass, California’s Constitution will be amended in such a way as to dramatically change our current sentencing laws. As you will see, the measure will also eliminate direct filing of juvenile cases in adult court by prosecutors and eliminates the presumptions that serious and violent offenders are unfit to be prosecuted in juvenile court. 

CDAA currently does not have an official position on the Governor’s proposal, but we wanted the membership to be aware of our preliminary analysis as we move to seek board action on this issue. CDAA will apprise you of any changes or additions to this analysis and continue to keep you in the loop as this measure progresses.
