How to Effectively and Ethically Pick Your Jury

This 1.5 day training is designed for prosecutors to understand the potential impact of intentional and unintentional bias in jury selection. This class will consist of both lecture on CCP 231.7, Ethical Closing Arguments and an Interactive Session. The new jury selection (voir dire) legislation codified in CCP 231.7 goes much further than Batson-Wheeler by eliminating the prima facie showing, creating a new objective standard that incorporates implicit bias, abolishing the requirement for purposeful discrimination, creating a list of presumptively invalid reasons, and instituting a “clear and convincing” standard to overcome the presumption. The goal of the legislation is laudable: “to put into place an effective procedure for eliminating the unfair exclusion of potential jurors based on race, ethnicity, gender, gender identity, sexual orientation, national origin, or religious affiliation, or perceived membership in any of those groups, through the exercise of peremptory challenges.” In the Interactive Session, experienced prosecutors will demonstrate both pitfalls and best practices when conducting voir dire within the CCP 231.7 landscape, with instructor-led discussions regarding how and when to exercise a peremptory challenge.
